Pepper Spray Lite (Stack Track) – Terms of Use and End User Licence
Version lite-2026-10-29.2 · Last updated 31 October 2026
These Terms are an agreement between you and Pepper Spray (a business trading under that name in New Zealand) ("we", "us"), the developer of the Pepper Spray: Stack Track app and the Pepper Spray Lite app (each "the App"). By ticking the boxes and tapping "Agree and continue", or by using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Who can use the App
You must be 18 or older and legally able to enter into this agreement where you live.
2. What the App is (and is not)
- The App is a personal record-keeping tool. It lets you write down things you choose to take, when you took them, schedules you set, and notes about how you felt.
- The App is not medical advice and is not a medical device. It does not diagnose, treat, cure or prevent any condition.
- Using the App does not create a doctor–patient or any other professional relationship with us.
- The App does not recommend, endorse, sell, supply or tell you where to obtain any substance, and does not recommend any dose or schedule. Any amounts, units or schedules in the App are entered by you.
- The vial calculator (concentration, syringe units, doses left) only does arithmetic on numbers you type in. It does not check whether an amount is safe or appropriate.
- Reminders are a convenience. They may be late, missed or wrong (for example if your phone is off, in battery-saving mode, or the settings are changed). Do not rely on them for anything important.
3. Your responsibilities
- You are solely responsible for any decision to take, not take, or stop any substance, and for any amount or schedule you use.
- You are solely responsible for complying with the laws where you live, including laws about importing, possessing, supplying or using medicines and other substances.
- You are responsible for the accuracy of what you enter, and for keeping your own backups. Data is stored only on your device and is lost if you uninstall the App or lose the device.
4. Assumption of risk
You understand that taking any substance, particularly unapproved or research compounds, carries risks, including serious and unknown risks. To the maximum extent permitted by law, you accept those risks yourself.
5. Release
To the maximum extent permitted by law, you release us from claims arising from your use of any substance, from decisions you make using information in the App, and from your reliance on the vial calculator or reminders.
6. Licence
We grant you a personal, non-exclusive, non-transferable licence to install and use the App on devices you own or control, for your own non-commercial use. A subscription key is for one person, is valid only for the period in the key, and must not be shared or resold. Licence check (full Pepper Spray app): when your device is online, the App downloads a public list of cancelled licence keys from peppersprayapp.com (a plain download; nothing about you or your data is sent). We may cancel a key at any time, for example if it was shared, refunded or obtained unfairly; a cancelled key returns the App to the free version. If a Pro key has not been checked for 14 days because the device was offline, Pro pauses until the App can check again. Your data is never deleted and export always stays available. You must not copy, modify, reverse engineer (except as permitted by law), redistribute, or remove notices from the App.
7. Free trial, subscription, Bitcoin payment and refunds
- Free trial: the App is free to use for 14 days from the first time you open it. No payment details are needed for the trial. When the trial ends, the App becomes read-only: you can still open it, view everything and export your data, but you cannot log new entries until you enter a valid subscription key.
- Price: Pepper Spray Lite is NZ$5.99 per month. The full Pepper Spray app is NZ$11.99 per month, or NZ$32.99 for 3 months, NZ$59.99 for 6 months or NZ$99.99 for 12 months (or as shown in the App before you pay). Because payment is made in Bitcoin, you send the Bitcoin amount equal to the NZ$ price of your plan at the time you pay. Network (miner) fees are paid by you. If the exchange rate moves after you send the payment, that does not change the price: neither of us owes the other the difference.
- How payment works: you send Bitcoin on the Bitcoin (BTC) network only to the address shown in the App, then send us the transaction ID and your install code using the Contact us form. When the payment has arrived we email you a subscription key, normally within 1–2 business days. Bitcoin sent on another network or to a wrong address may be lost and cannot be recovered by us.
- No automatic renewal: we cannot take money from you. Each plan period is a separate payment. Your key works until the expiry date in it plus a 3-day grace period; to continue, pay again and we send a new key. If you do not renew, Pepper Spray Lite returns to read-only and the full app returns to its free tier. Your data is never deleted because of an expired key.
- Keys: each key is for your personal use on your own install of the App and must not be shared or resold. We may revoke a key that has been shared, refunded or obtained fraudulently; revocation takes effect from a later version of the App.
- Refunds: if you change your mind, tell us within 7 days of paying and we will refund that payment (in Bitcoin, the BTC amount equal to the NZ$ price paid, less network fees, to an address you give us). We may also refund at our discretion. None of this limits your rights under the Consumer Guarantees Act 1993 or other consumer law (section 11), including a refund or other remedy if the App has a fault or is not as described.
- If you reinstall the App or change phones, you are not entitled to another free trial; contact us and we will move your subscription to your new install code.
8. Disclaimer of warranties
To the maximum extent permitted by law, the App and all content are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted or error-free operation.
9. Limitation of liability
To the maximum extent permitted by law:
- we are not liable for any indirect, incidental, special or consequential loss, or for any loss of data, health, profit or opportunity; and
- our total liability to you for all claims relating to the App is limited to the amount you paid us in the 12 months before the claim (or NZ$1 if you paid nothing).
10. Indemnity
To the maximum extent permitted by law, you agree to cover our reasonable losses and costs arising from your breach of these Terms or your breach of any law in connection with your use of the App.
11. Your consumer rights are not affected
Nothing in these Terms excludes, restricts or modifies any right or remedy you have that cannot lawfully be excluded, including (if they apply to you) rights under the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, the Australian Consumer Law, and consumer protection laws of the UK, EU or elsewhere. Where such laws apply, sections 4, 5, 8, 9 and 10 apply only to the extent permitted by those laws. If you are buying for business purposes in New Zealand, the parties agree the Consumer Guarantees Act does not apply, to the extent permitted by section 43 of that Act.
12. Privacy
Your data stays on your device. The App has no internet permission, no account, no analytics and no ads. Everything you enter is stored only on your phone. We only receive what you choose to send us through the contact form (for example your transaction ID, install code and email address), which we keep to manage your subscription and meet tax record-keeping obligations. Exported backup files are under your control.
13. Changes
We may update these Terms. If we do, the App will show the new version and ask you to accept it before you continue. If you do not accept, stop using the App.
14. Ending this agreement
You can stop using the App at any time by uninstalling it. We may end your licence if you materially breach these Terms. Sections 3–5 and 8–11 survive.
15. Governing law
These Terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction. This does not take away any right you have to bring a claim in the courts of the country where you live under mandatory consumer laws.
16. Severability
If any part of these Terms is found unenforceable, it will be limited to the minimum extent needed, and the rest remains in effect.
